A new statutory authority, the Australian Charities and Not-for-Profits Commission (ACNC), will be established to commence operations from 1 July 2012, to become a national regulator for the not-for-profit (NFP) sector.

This new authority will inevitably transform Australia’s $43 billion NFP sector and have important implications for NFP boards.

Under the new regime NFP directors will need to be asking their organisations the following questions:

Will all our activities meet the required definitions of charitable purposes?
Will we be able to meet the reporting requirements?
Do we have open and transparent reporting in our annual report and financial statements?
Are we in a suitable position to monitor the detail of the legislation as it is introduced so, if necessary, we can advocate for it or for changes?
